Terms of Service

These Terms govern your use of Africanlicious, operated by Bright Future Global LLC (California, USA). Please read them carefully.

1. Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you and Bright Future Global LLC, a limited liability company organized under the laws of the State of California, United States of America ("Africanlicious", "we", "us", "our"), operator of the Africanlicious websites, mobile applications and progressive web app (together, the "Service"). By creating an account, placing an order, listing a restaurant, accepting delivery jobs or otherwise using the Service, you accept these Terms, our Privacy Policy, Cookie Policy and Refund & Cancellation Policy, which are incorporated by reference.

If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of a business (for example a restaurant or fleet), you represent that you have authority to bind that business and that "you" refers to that business.

2. Eligibility and accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an Africanlicious account. Restaurant and driver accounts must be operated by a person legally authorised to do so. You agree to (i) provide accurate, current and complete information, (ii) keep your credentials secure, (iii) be responsible for all activity that occurs under your account, and (iv) notify us immediately at support@africanlicious.com of any unauthorised use.

We may refuse, suspend or terminate accounts for any lawful reason, including suspected fraud, repeated chargebacks, abuse of staff or couriers, or breach of these Terms.

3. What Africanlicious is — and is not

Africanlicious is an online marketplace and logistics technology platform that lets customers discover, order and pay for food, groceries and related products supplied by independent restaurants, home cooks, chefs, grocers and other vendors (each a "Restaurant"). Where a Restaurant does not operate its own fleet, Africanlicious may arrange delivery via approved independent couriers ("Drivers").

Africanlicious does not prepare, cook, store, label or sell food. The contract for the food is between you and the Restaurant. Africanlicious facilitates discovery, ordering, payment, customer support and (where applicable) delivery. Where Africanlicious itself acts as agent of the Restaurant for collecting payment, that role is disclosed at checkout.

4. Orders, prices and payment

Placing an order is an offer by you to purchase from the Restaurant on the terms shown at checkout. The contract is formed when the Restaurant accepts the order and we send you a confirmation. Until then we may decline an order — for example if items are out of stock, the kitchen is closed, the delivery address is outside the service area, or payment cannot be authorised.

  • Prices. Prices are set by the Restaurant. Service fees, delivery fees, small-order fees, packaging fees and applicable taxes (VAT, sales tax, GST, etc.) are shown before you confirm.
  • Payment. We accept the payment methods displayed at checkout (including Flutterwave, PayPal, Stripe and supported local methods). You authorise us and our payment processors to charge your selected method for the order total and any authorised adjustments (e.g. tips, items added at the door).
  • Receipts. A digital receipt is available in your account and is emailed to the address on file.
  • Pricing errors. If we discover a manifest pricing error before dispatch we may cancel the affected order and refund you in full.

5. Delivery, pickup and scheduling

Estimated preparation, pickup and delivery times are estimates provided by the Restaurant or generated by our routing software. Actual times may vary due to traffic, weather, kitchen volume, courier availability or other conditions outside our control.

  • Address & access. You must provide an accurate delivery address and access details (gate codes, apartment number, building name). You agree to be available to receive the order during the delivery window.
  • Contactless & leave-at-door. Where selected, you assume risk of loss when the order is left at the agreed location and a delivery photo is recorded.
  • Failed delivery. If we cannot reach you after reasonable attempts within the service window, the order may be cancelled with no refund for the food prepared.
  • Scheduled orders. Scheduled orders are released to the kitchen ahead of your slot; cancellation rules in section 6 apply from that point.

6. Cancellations and refunds

Our full Refund & Cancellation Policy describes when an order can be cancelled and how refunds are calculated. In summary:

  • Before the Restaurant accepts — cancel for a full refund.
  • After acceptance but before cooking starts — typically a full refund minus payment processor fees.
  • Once cooking has started — cancellation is generally not possible because ingredients have been committed for you.
  • Quality, missing-item or food-safety issues — contact complaints@africanlicious.com within 24 hours of delivery with a photo and short description.

Nothing in these Terms removes statutory consumer rights you have under the laws of your country, state or province.

7. Reviews, ratings and user content

You may post reviews, ratings, photos and other content ("User Content"). You retain ownership but grant Africanlicious a worldwide, royalty-free, sublicensable licence to host, display, reproduce and adapt your User Content in connection with operating and promoting the Service.

User Content must be lawful, accurate and respectful. We may remove or restrict content that is defamatory, harassing, discriminatory, deceptive, infringes third-party rights, reveals personal data of staff or couriers, or otherwise violates our community standards.

8. Acceptable use

You agree not to, and not to permit any third party to:

  • Use the Service for unlawful purposes or to violate any applicable law;
  • Interfere with the Service, scrape data at scale, or attempt to access non-public areas;
  • Resell, sublicense or commercially exploit the Service without our consent;
  • Impersonate any person, including couriers, restaurant staff or our employees;
  • Harass, threaten or discriminate against any user, courier or restaurant; or
  • Submit fraudulent payment instruments, manipulate refunds, or open multiple accounts to circumvent suspensions.

9. Restaurant and Driver partner terms

Restaurants

Restaurants are independent businesses solely responsible for: food safety, hygiene, allergen disclosures, accurate menu and pricing information, licences, taxes, employee and contractor obligations, and compliance with all applicable food, labelling, alcohol and packaging laws. Restaurants grant Africanlicious the right to display their menus, logos and photos on the Service and to act as their limited collection agent for customer payments where local law allows.

Drivers

Drivers operate as independent contractors and are responsible for: a valid driving licence, roadworthy vehicle, valid insurance, right to work in their jurisdiction, tax obligations and complying with traffic and food-handling laws. Drivers must follow the in-app safety, hygiene and conduct rules and may be deactivated for serious or repeated breaches.

Payouts

Partner payouts run on the schedule shown in the partner dashboard, subject to verification, chargebacks and adjustments. Disputes about payouts should be sent to services@africanlicious.com.

10. Promotions, credits and referrals

Promotional codes, credits and referral rewards are non-transferable, have no cash value, may be limited to specific users, restaurants, cities or order types, and may expire. We may withdraw or modify a promotion if we reasonably suspect abuse, multi-accounting or fraud.

11. Intellectual property

The Service, including the Africanlicious name, logo, designs, software and content (other than User Content and Restaurant content) is owned by Bright Future Global LLC or its licensors and is protected by copyright, trademark and other laws. Subject to these Terms we grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal, non-commercial use.

12. Third-party services

The Service uses third-party providers (for example payment processors, mapping, SMS, push notification and analytics vendors). Your use of those features is subject to the third party's own terms. Africanlicious is not responsible for third-party services beyond our reasonable control.

13. Disclaimers

To the maximum extent permitted by law the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory or otherwise, including merchantability, fitness for a particular purpose, non-infringement and uninterrupted operation. We do not warrant that any specific Restaurant will be open, that any specific item will be available, or that any specific delivery time will be met.

14. Limitation of liability

To the maximum extent permitted by law, in no event will Bright Future Global LLC, its affiliates, officers, employees or agents be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid to Africanlicious in the 6 months preceding the claim, or (b) USD 100. Nothing in these Terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by our negligence or for fraud.

15. Indemnity

You agree to indemnify, defend and hold harmless Bright Future Global LLC and its affiliates from and against any claims, damages, losses and expenses (including reasonable legal fees) arising from (i) your breach of these Terms, (ii) your User Content, (iii) your violation of any law or third-party right, or (iv) for partners, the products or services you supply through the Service.

16. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk for the Service or other users, or if we are required to do so by law. You may close your account at any time from the account screen or by emailing support@africanlicious.com.

17. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. The federal and state courts located in California, USA have exclusive jurisdiction over any dispute that is not subject to arbitration under this section, except that either party may bring small-claims actions in the courts of the consumer's residence where local law requires.

Informal resolution. Before filing a claim, you agree to contact legal@africanlicious.com and try in good faith to resolve the dispute for at least 30 days.

Arbitration (US users). Where permitted by law, any dispute not resolved informally will be settled by binding individual arbitration under the rules of the American Arbitration Association. You and Africanlicious each waive the right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@africanlicious.com.

EU/UK users. Nothing in this section limits mandatory consumer protections in your country of residence, including the right to bring proceedings in the courts of your domicile.

18. Changes to these terms

We may update these Terms from time to time. Material changes will be announced in-app or by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
