Africanlicious — Terms of Service
1. About These Terms
Welcome to Africanlicious. These Terms of Service ("Terms") form a legally binding agreement between you ("you," "your," or "Customer") and Africanlicious LLC, a California limited liability company located at 23679 Calabasas Road, Suite 416, Calabasas, CA 91302, United States ("Africanlicious," "we," "us," or "our").
By accessing or using the Africanlicious website, mobile applications, or any related services (collectively, the "Platform"), you agree to these Terms. If you do not agree to these Terms, do not use the Platform.
We may update these Terms at any time. We will notify you of material changes by email or by posting an updated version on the Platform. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
2. What Africanlicious Is — and Is Not
Africanlicious is an online marketplace platform. We provide technology that connects customers with independent third-party food vendors ("Vendors") who prepare, sell, and deliver food directly to customers.
Africanlicious is NOT:
- a restaurant, food preparation business, or food provider;
- a seller, reseller, or distributor of food;
- a delivery service, carrier, or logistics provider;
- an employer, agent, partner, or joint venturer of any Vendor;
- a guarantor of any Vendor's products, services, or conduct.
When you place an order through the Platform, you are entering into a direct contract with the Vendor who prepares and delivers your food. Africanlicious is not a party to that contract. We facilitate the transaction by providing the technology, processing payment as the Vendor's limited agent, and offering basic dispute support — nothing more.
You acknowledge and agree that all food sold through the Platform is prepared, packaged, handled, and delivered by Vendors, who are solely responsible for compliance with all applicable food safety, hygiene, labeling, allergen disclosure, licensing, and consumer protection laws in their location.
3. Eligibility
To use the Platform, you must:
- be at least 16 years old;
- have the legal capacity to enter into binding contracts in your jurisdiction (a parent or legal guardian must approve any order placed by a minor between 16 and the age of majority in their country);
- provide accurate, current, and complete information when creating an account;
- not be prohibited from using the Platform under any applicable law.
Customers under 18 (or under the age of majority in their jurisdiction) may use the Platform only with parental or guardian consent. The parent or guardian assumes full responsibility for the minor's orders and conduct on the Platform.
4. Your Account
You may need to create an account to place orders. You are responsible for:
- maintaining the confidentiality of your account credentials;
- all activity that occurs under your account;
- promptly notifying us at Info@Africanlicious.com of any unauthorized use.
We reserve the right to suspend or terminate accounts at our discretion, particularly in cases of fraud, abuse, violation of these Terms, or extended inactivity. We may delete inactive accounts after a reasonable period in accordance with standard marketplace practice.
5. Placing Orders
When you place an order on the Platform:
- you make a direct purchase from the selected Vendor;
- you agree to the price, fees, delivery method, and any specific terms shown at checkout;
- payment is processed through the Platform as a service to the Vendor, who remains the legal seller of the food;
- the order is confirmed only once the Vendor accepts it.
Prices, availability, delivery options (pickup, same-day delivery, overnight shipping), and delivery windows are set by each Vendor and may vary by location and time. We do not control these elements.
You authorize Africanlicious to charge your selected payment method for the total amount of your order, including applicable service fees and taxes.
6. Cancellations
By the Customer. You may cancel your order at no charge before the Vendor begins preparation. Once the Vendor has started preparing your food, cancellations are at the Vendor's discretion and a refund is not guaranteed. To request a cancellation, contact the Vendor immediately using the contact information visible on your order page.
By the Vendor. A Vendor may cancel an order before preparation begins if they are unable to fulfill it (for example, an item is out of stock or they are temporarily closed). In this case, you will receive a full refund of the order amount.
Failed Delivery. If the Vendor fails to deliver your order (for example, the order is never dispatched or the Vendor becomes unresponsive after preparation), you are entitled to a full refund.
7. Food Quality, Issues, and Refunds
7.1 Vendor Responsibility
The Vendor is solely and fully responsible for:
- the quality, safety, freshness, taste, and temperature of food at delivery;
- accurate product descriptions, ingredients, and allergen disclosure;
- compliance with all food safety, hygiene, labeling, and licensing laws in their operating location;
- packaging and transportation of food in a manner that preserves quality and safety;
- meeting the delivery time and method agreed at checkout;
- issuing refunds or replacements when required.
7.2 Reporting an Issue
If you experience a problem with your order — including cold food, late delivery, missing items, incorrect items, allergic reactions, or food safety concerns — you must report it within 24 hours of delivery by:
- First, contacting the Vendor directly using the contact information visible on your order page;
- If the Vendor does not respond within a reasonable time or refuses to resolve the issue, escalating to Africanlicious at Info@Africanlicious.com.
Issues reported after the 24-hour window may not qualify for refunds or remediation.
7.3 Refunds
Refunds may be issued by the Vendor as:
- a full refund of the order;
- a partial refund for the portion of the order affected;
- store credit redeemable on a future order.
The form of refund is determined by the Vendor in consultation with the Customer. Africanlicious does not guarantee any specific refund outcome and is not the primary party responsible for issuing refunds.
7.4 Africanlicious's Role in Disputes
Africanlicious acts as second-line support only. We will assist when a Vendor fails to respond or unreasonably refuses to resolve a legitimate issue. Our typical response time is approximately 48 business hours. We do not guarantee any specific resolution, and our intervention is offered as a courtesy, not as a contractual obligation under these Terms.
8. Allergens, Dietary Information, and Health
Food sold on the Platform is prepared by independent Vendors in their own kitchens. Cross-contamination and inconsistent allergen handling are possible. Customers with food allergies, intolerances, or dietary restrictions are responsible for:
- reading the allergen and ingredient information provided by the Vendor;
- contacting the Vendor directly before ordering with any specific questions or concerns;
- using their own judgment about whether to order.
Africanlicious does not verify allergen information and is not liable for any allergic reaction, illness, or adverse health effect resulting from food purchased through the Platform. The Vendor bears full responsibility for accurate allergen disclosure and safe food handling.
9. Payments
9.1 Payment Processing
We process payments on behalf of Vendors as their limited payment collection agent. Payment by you to Africanlicious is treated as payment to the Vendor.
9.2 Fees
The total amount you pay may include:
- the price of the food set by the Vendor;
- delivery or shipping fees set by the Vendor;
- a service fee charged by Africanlicious for use of the Platform;
- applicable taxes (sales tax, VAT, etc.).
All fees are disclosed at checkout before you confirm your order.
9.3 Currency
Prices are displayed in your local currency where supported, with conversion based on prevailing exchange rates. Final charges to your payment method may vary slightly due to currency conversion fees applied by your bank.
9.4 Failed Payments
If a charge fails or is reversed (chargeback, dispute, insufficient funds), we reserve the right to suspend your account, charge an alternative payment method on file, and recover any amounts owed through reasonable means.
10. Customer Conduct
When using the Platform, you agree NOT to:
- provide false, misleading, or inaccurate information;
- impersonate any person or entity;
- use the Platform for any unlawful, fraudulent, or harmful purpose;
- harass, threaten, defame, or abuse Vendors, delivery personnel, or other users;
- interfere with the Platform's operation, security, or features;
- attempt to scrape, copy, reverse-engineer, or extract data from the Platform;
- post reviews or content that is false, misleading, defamatory, hateful, obscene, or otherwise unlawful;
- use the Platform to violate the rights of any third party, including intellectual property rights.
Violation of these standards may result in suspension or termination of your account, refusal of service, and where appropriate, legal action.
11. Reviews and User Content
You may post reviews, ratings, photos, comments, and other content ("User Content") on the Platform. By submitting User Content, you:
- represent that the content is truthful, accurate, and your own;
- grant Africanlicious a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, publicly display, and create derivative works of your User Content in any media, for any purpose related to the Platform or the promotion of Africanlicious;
- agree that we may remove or edit User Content at our discretion, without notice;
- agree not to post content that is unlawful, infringing, defamatory, hateful, sexually explicit, or otherwise inappropriate.
We do not endorse or take responsibility for User Content, and we are not liable for any opinions or claims expressed in User Content by other users.
12. Intellectual Property
All content on the Platform — including the Africanlicious name, logo, design, branding, software, text, graphics, photos provided by Africanlicious, and underlying technology — is owned by Africanlicious or its licensors and is protected by intellectual property laws. You receive only a limited, non-transferable, revocable license to use the Platform for its intended purpose. You may not copy, modify, distribute, sell, or commercially exploit any part of the Platform without our prior written permission.
Photos and content uploaded by Vendors remain the property of the respective Vendor, who grants Africanlicious a license to use such content for Platform operation and promotion.
13. Disclaimers
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. AFRICANLICIOUS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, AFRICANLICIOUS MAKES NO REPRESENTATION OR WARRANTY THAT:
- THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
- FOOD OR SERVICES PROVIDED BY VENDORS WILL MEET YOUR EXPECTATIONS, BE SAFE, BE OF SATISFACTORY QUALITY, OR COMPLY WITH ANY SPECIFIC STANDARD;
- ANY VENDOR IS LICENSED, INSURED, QUALIFIED, OR COMPLIANT WITH LOCAL LAW;
- INFORMATION DISPLAYED ON THE PLATFORM (INCLUDING PRICES, AVAILABILITY, ALLERGENS, INGREDIENTS, DELIVERY TIMES) IS ACCURATE OR COMPLETE.
YOUR USE OF THE PLATFORM AND ANY VENDOR'S PRODUCTS OR SERVICES IS AT YOUR SOLE RISK.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
AFRICANLICIOUS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
AFRICANLICIOUS SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR CLAIMS ARISING OUT OF OR IN CONNECTION WITH:
- ANY FOOD, GOODS, OR SERVICES PROVIDED BY A VENDOR, INCLUDING ANY ILLNESS, INJURY, ALLERGIC REACTION, OR DEATH;
- THE QUALITY, SAFETY, FRESHNESS, ACCURACY, OR LEGALITY OF ANY VENDOR'S OFFERINGS;
- FAILURE TO DELIVER, LATE DELIVERY, OR INCORRECT DELIVERY BY A VENDOR OR ITS DELIVERY PARTNERS;
- ANY ACT, OMISSION, MISCONDUCT, OR NEGLIGENCE BY A VENDOR;
- ANY DISPUTE BETWEEN YOU AND A VENDOR;
- UNAUTHORIZED ACCESS TO OR USE OF YOUR ACCOUNT.
IN NO EVENT SHALL AFRICANLICIOUS'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT OF SERVICE FEES (NOT INCLUDING VENDOR FOOD COSTS) PAID BY YOU TO AFRICANLICIOUS IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Africanlicious and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- your use of the Platform;
- your breach of these Terms;
- your violation of any law or third-party right;
- any dispute between you and a Vendor;
- any User Content you submit.
16. Governing Law and Disputes
16.1 Governing Law
These Terms and any disputes arising under them are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
16.2 Informal Resolution First
Before initiating any formal legal action, you agree to attempt to resolve the dispute informally by contacting us at Info@Africanlicious.com. We will respond within a reasonable time and work in good faith toward a resolution. You may not file a lawsuit unless and until at least 60 days have passed since your written notice.
16.3 Venue
If informal resolution fails, you agree that any dispute, claim, or legal action arising out of or related to these Terms or the Platform shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you submit to the personal jurisdiction of those courts.
16.4 Class Action Waiver
To the extent permitted by law, you agree that any dispute will be brought on an individual basis only, and not as a plaintiff or class member in any class, consolidated, or representative action.
16.5 Limitation Period
Any claim arising out of or related to these Terms or the Platform must be filed within one (1) year after the cause of action arises, otherwise it is permanently barred.
17. Geographic Availability
Africanlicious operates as a marketplace platform across multiple countries, subject to local laws and the availability of approved Vendors in each location. The list of countries and cities served may change at any time. We make no representation that the Platform is appropriate or available in any particular jurisdiction, and access to the Platform from territories where its content is illegal is prohibited.
Customers are responsible for complying with all local laws applicable to their use of the Platform and their orders.
18. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and dispute resolution) will continue in effect.
19. Miscellaneous
Entire Agreement. These Terms, together with our Privacy Policy and any additional terms accepted at checkout, constitute the entire agreement between you and Africanlicious regarding the Platform.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
No Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
Assignment. You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.
Force Majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, government actions, internet outages, or third-party service failures.
No Agency. Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you, Africanlicious, and any Vendor.
Notices. We may provide notices to you by email, through the Platform, or by posting on the Platform. You must send notices to us at:

By using the Africanlicious Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
